Case brief on Hills and Dales General Hospital
Hills and Dales General Hospital Legal Battle
Hills and Dales General Hospital got involved in a legal battle with two physicians and Huron Medical Center, accusing the trio of violating a covenant not to compete. The circuit court in Tuscola dismissed the engagement in business practice stating that Pantig and Oxholm-Dababneh are residents of Lapeer and Oakland in that order and there is no proof to show that either defendant did any business in Tuscola County in the time of filing the lawsuit. In a formal written order and opinion, the court dismissed the case of venue change citing the strategic positioning of the Tuscola County for Huron medical to perform its business adventures with a wrong timing of the filing of the venue change citing the strategic positioning of the Tuscola County for Huron medical to undertake its business adventures with a wrong timing of the filing of the venue change motion (Dagen-Sunsdahl 373).
After the case dismissal in the Tuscola Circuit Court, Michigan, the defendants felt unsatisfied with the ruling, hence appealed the case. The appellate court held the Tuscola Circuit Court in errs finding no clear and accurate business connection between Huron Medical and the selected venue change. Appellate court judges, further, discovered that the defendants neither operate nor own any business in the Tuscola County. Their business in the county of conflict, however, took a different nature holding only stock which, according to the ruling, amounts to a separate entity other than the Huron Medical services in question. The appellate court also found no evidence supporting the allegation that the Huron Medical Center had a formal control of the economic activities undertaken by the two clinics established in the Tuscola County and that venue motion was undertaken at the right time as provided for under MCR 2.221 reversing the earlier judgment reversing the ruling that favored the plaintiff. The defendants, therefore, continued with their activities (Dagen-Sunsdahl 372).
