Toxic Waste Disposal in Massachusetts
Liquid waste is also known as hazardous waste and refers to all domestic and industrial effluent disposed of through sewages which may be disposed into nearby water bodies. To address the irresponsible liquid waste disposal in Massachusetts, the state legislators enacted the Sitting Act (Massachusetts Hazardous Waste Facility Siting Act) of 1980.
This legislation was intended to promote the development of liquid waste treatment and disposal facilities that offer sufficient security and protection of population health, safety, and environment (Provost). The legislation limited the municipalities’ power to regulate liquid waste institutions or to exclude them through changes in zoning. Further, the act recognized the treatment and disposal of liquid wastes as acceptable uses of any Massachusetts’ lands categorized as industrial zones by declaring them as-of-right uses.
