Fourth, while the lawyers can present evidence to the court, it is the judge who determines whether the evidence that the parties intend to use in a case is improper or illegal. If the lawyers present unlawful or improper evidence in a case, the judge may throw out the evidence.
Position 5: Giving Jury Instructions and Final Decision
Lastly, in a court case, before the jury starts deliberating on the facts of the case, the judge gives the jury instructions. The instructions the judge gives on the law apply to the case and the standards and have to be employed in deciding the case. In deciding the case, it's still the judge's role to give the final decision on the case.
